Three cases in eighteen months
Grøn Elforsyning, April 2025: DKK 700,000
The Ombudsman reported the company to the police in October 2024. The case was about 27 consumers called without valid consent between October 2022 and July 2024. 17 of them were also misled: promised savings by salespeople who did not know their current agreement, and by salespeople who introduced themselves under a different name. The company accepted a fine of DKK 700,000 (Consumer Ombudsman).
Modstrøm, January 2026: DKK 400,000
The case covered two periods, December 2020 to August 2021 and May 2023 to November 2024. 27 consumers were called without valid consent, and eight were misled, among other things into believing the caller was from their current electricity supplier. The Ombudsman stressed that the company had broken the rules before and paid a fine in 2021 (Consumer Ombudsman).
ENLY, July 2026: reported to the police again
The company formerly called Grøn Elforsyning was reported to the police for a second time. The case is about 47 consumers who are said to have been called without consent between July 2024 and September 2025, 41 of whom are said to have been misled. The company has said it had bought the consumers' consents from partners. The Ombudsman does not consider the consents valid and holds that the company was responsible for making sure they were, also when bought (Consumer Ombudsman). The case has not been decided.
What the cases have in common
- It was consent, not the Robinson list. The cases are about calls without valid consent. Electricity is not one of the four exceptions in section 4 of the Consumer Contracts Act, so every sales call to a consumer needs the consumer's prior, explicit request (retsinformation.dk).
- Relatively few consumers. 27 consumers were enough for fines of DKK 400,000 and DKK 700,000.
- Misleading talk on the call. The large fines combine unlawful calls with misleading statements about who is calling or what the customer saves.
- Bought consents don't protect you. The responsibility stays with the caller.
Where the Robinson list comes in
The Robinson list does not decide whether a consent is valid. Only your own documentation can. But it matters in two ways:
- Addressed mail. If you send offers with a name and address to households that are not customers, the Robinson list is decisive: if the person is on it, you may not send the letter.
- A warning flag in the call list. A person who has signed up for the Robinson list has said no to marketing in general. If you hold a consent from that person, the documentation must be in perfect order. Some suppliers leave them out of the call list.
Questions and answers
May energy companies call existing customers?
A new agreement or an upsell follows the same ban as for other consumers: there must be a prior request. Being a customer is not the same thing. A call about running the existing agreement is not a sales call.
What if our partner made the calls?
If a partner calls on your behalf to sell your product, it is your marketing. The Ombudsman has reported both energy companies and the lead companies involved.
Have the fines gone up?
Not clearly. DKK 700,000 in April 2025, then DKK 400,000 in January 2026. What has become stricter is that the Ombudsman now also goes after bought consents.
What to do now
- Go through your consents. Does the consent text name your company? The phone and the product? Can you document when and how it was given? Is it under a year old?
- Check call lists and address lists against the Robinson list right before they are used.
- Run your own suppression list against every new list.
- Review the script. Say who you are, and don't promise savings you can't document.
- Keep the documentation, for the consent and for the check.
Robinsontjek handles point 2 and the record of it. We connect to your CRM, dialer or print house so every list is checked, and each list gets a check receipt. Read Robinson list checks for energy and utility companies, or write to us and we'll set the check up for you.
