Contact These terms apply when a business uses Robinsontjek. Robinsontjek is provided by a self-employed business in Portugal ("we"). Our name, NIF and VAT number are on your invoice and in the terms inside the app. The customer is "you". Robinsontjek is sold to businesses only. Consumer rights of withdrawal do not apply. *This English version is provided for convenience. If it conflicts with the Danish [handelsbetingelser](https://robinsontjek.dk/juridisk/handelsbetingelser), the Danish version prevails.* ## 1. What Robinsontjek is 1.1. Robinsontjek checks your lists of people against the Danish Robinson list from the CPR register. For each row we report what we found, as a level from 0 (nobody on the list at the address) to 5 (the same name and address is on the list), what matched, and which edition of the list we checked against. You choose the level you go by. If you don't choose, we use level 1, the most cautious. Your level is used when we make a file with only the rows below it, and when we send results to your systems. 1.2. Robinsontjek is a private service. We are not part of the CPR register, the CVR register or any authority. The Robinson list belongs to the CPR register, and we check against the latest edition we have received. 1.3. If we can't read or find the address on a row, the row says so and gets no level. It is never included in a file of rows below your level. 1.4. Robinsontjek is not legal advice. We don't assess whether you have valid consent, whether your product is exempt from the Danish ban on sales calls, or whether your marketing is otherwise lawful. That is your responsibility. 1.5. A result shows what we found when the list was checked against the edition of the Robinson list stated on the result and on the check receipt. It is based on the names and addresses you sent. It is not an assessment of whether you may contact a given person, and the check receipt is not a legal assessment of your marketing. ## 2. Plans and prices 2.1. **Annual plan.** DKK 15,000 per year. Includes setup and integration with your systems as agreed, unlimited lists and rows, API, check receipts, rechecks of saved lists when a new Robinson list is published and support. 2.2. **Per list.** DKK 995 for a list of up to 500 rows and DKK 5,000 for a list of more than 500 rows. Includes results for every row, a file of the rows below your level and a check receipt. 2.3. **Other agreements.** Partner deals are agreed separately in writing. So are phone number lookups and company checks in CVR, which are add-ons and not part of the annual plan. A separate agreement takes precedence over these terms. 2.4. All prices are in Danish kroner (DKK) and exclude VAT. We are established in Portugal and sell to businesses in the EU, so no VAT is charged. This is the reverse charge: you account for the VAT on the service yourself under the rules of your country (Article 196 of Council Directive 2006/112/EC). Give us your VAT number when you pay, so it appears on the invoice. 2.5. We may change prices with 3 months' notice. A change to an annual plan takes effect at the next renewal. ## 3. Payment 3.1. The annual plan is paid a year in advance, by card or by invoice with 14 days' payment terms. 3.2. Per-list checks are paid by card before the list is checked. 3.3. Late payment may incur interest under the Danish Interest Act and a reminder fee as permitted by law. If an invoice is unpaid 14 days after its due date and a written reminder, we may suspend access until payment is made. 3.4. Card payments are handled by our payment provider. We don't see or store card details. ## 4. Term and termination 4.1. The annual plan runs for 12 months from sign-up and renews automatically for 12 months at a time. 4.2. You may cancel the annual plan at the end of the current period by giving notice at least 30 days before it ends, in writing to [kontakt@robinsontjek.dk](mailto:kontakt@robinsontjek.dk) or in your account. 4.3. Payments for a started period are not refunded, except as set out in section 9. 4.4. Either party may terminate for material breach that has not been remedied 14 days after written notice. 4.5. When the agreement ends, we delete your data as set out in the data processing agreement. Check receipts can be downloaded for 30 days after termination. ## 5. Your obligations 5.1. You may only send lists you are entitled to process, and only to find out whom you may contact with marketing. 5.2. Don't send Danish CPR numbers, special category data or anything not needed for the check. Name and address are enough. 5.3. You may not use Robinsontjek to map who is on the Robinson list, to build a copy of it, or to pass results to anyone other than those on whose behalf you contact people. 5.4. You are responsible for keeping logins and API keys secure, and for everything done with your keys. 5.5. Don't try to bypass technical limits, place abnormal load on the service, or test its security without our written agreement. ## 6. Our obligations 6.1. We provide the service with the care expected of a professional supplier. 6.2. We switch to a new edition of the Robinson list as soon as possible after the CPR register publishes it. Every result shows which edition it was checked against. 6.3. We aim for the service to be available around the clock. Planned maintenance is announced where possible. We don't guarantee uninterrupted service. 6.4. Support is available by email and chat on Danish working days. ## 7. Personal data 7.1. When we check your lists, we act as your processor. The [data processing agreement](https://app.robinsontjek.dk/legal/dpa) forms part of these terms and is accepted with them. 7.2. Our own processing of information about you as a customer is described in the [privacy policy](https://robinsontjek.dk/en/legal/privacy). ## 8. Liability 8.1. We are liable under the general rules of Danish law, subject to the limitations below. 8.2. We are not liable for indirect loss, including lost revenue, lost profit, loss of data or loss of goodwill. 8.3. We are not liable for fines, claims or losses arising from: - errors or omissions in the Robinson list or the CVR register, - errors, omissions or outdated details in the lists you sent, such as wrong or incomplete names and addresses, - how you or others use the result or the check receipt, - a person being added to the Robinson list after the edition checked against was published, - your contacting people on rows where we found a match at or above the level you go by, or where the address could not be read, - your choice of level, - your use of a result older than the current edition of the Robinson list, - matters that are your responsibility under sections 1.4 and 5. 8.4. Our total liability is limited to the amount you paid for the service in the 12 months before the event giving rise to the claim. 8.5. These limitations don't apply in case of intent or gross negligence. 8.6. Neither party is liable for events beyond its control that it could not reasonably have foreseen, such as failures of power or internet providers, war, natural disasters, strikes or orders from authorities (force majeure). ## 9. Errors in a check If you believe a result is wrong, write to us within 30 days. If the error is ours, we recheck the list free of charge. If a per-list check was wrong because of our error, you may choose a refund for that list. ## 10. Rights 10.1. Your lists and the results of the check belong to you. 10.2. Software, design and documentation belong to us. You receive a non-exclusive right to use the service while the agreement runs. 10.3. We may use aggregated, anonymous figures that can't be traced to you or to individuals to improve the service and to publish statistics about the Robinson list. ## 11. Confidentiality Each party keeps the other party's business information confidential, also after the agreement ends. ## 12. Changes to these terms We may change these terms with 30 days' written notice. If a change is materially to your disadvantage, you may terminate with effect from the change and receive a pro rata refund of any prepaid period. ## 13. Governing law and venue These terms are governed by Danish law. Disputes that the parties can't resolve by negotiation are settled by the ordinary Danish courts. ## 14.
